Partner of a Student Visa NZ: Support Your Partner’s Educational Journey

The Partner of a Student Visa NZ enables couples to stay together while one partner pursues education in New Zealand. At ASIC Auckland South Immigration Consultant, we help couples navigate this pathway for family unity during educational pursuits.

Purpose and Types

The Partner of a Student Visa NZ allows the partner of a student visa holder to stay in New Zealand during the study period. Depending on the student’s qualification level, the partner may qualify for a work visa with full employment rights or a visitor visa with no work rights. The partner visa usually expires at the same time as the student’s visa.

When Work Rights Are Allowed

The partner can apply for a work visa if the student is enrolled in Level 9 or 10 qualifications (Master’s or PhD programs). Work rights are also granted when the student studies Level 7 or 8 qualifications listed on the Green List, covering skill shortage areas. Additionally, work rights may be available if the student’s program leads to a Post-Study Work Visa or is linked to skills in demand.

If the student’s qualification falls below these levels or is not on the Green List, the partner can only apply for a visitor visa, allowing staying but prohibiting employment.

Eligibility Requirements

To qualify for a Partner of a Student Visa NZ, you must demonstrate a genuine and stable relationship with the student visa holder through comprehensive evidence. You must meet health and character requirements, including medical examinations and police certificates if required.

Financial requirements mandate showing proof of financial support or sufficient funds to cover your stay, typically around NZD 4,200 or more.

Duration and Validity

The Partner of a Student Visa NZ is generally issued for the same duration as the student’s visa. All conditions must remain valid for the full visa period, meaning work rights only apply while your partner’s study program continues to qualify.

Rights and Conditions

If granted a work visa under the Partner of a Student Visa NZ category, you can work full-time for any employer in New Zealand. If granted a visitor visa, you cannot work, but you may stay with your partner during their studies. Under certain conditions, you may study short courses for up to three months. Over time, eligible partners may also progress toward a Residence Visa, provided they meet Immigration New Zealand’s partnership and settlement criteria.

Bringing Dependent Children

Dependent children may be eligible for their own student visas or visitor visas depending on the parent’s visa type. Children can typically attend school in New Zealand on a student visa.

Application Process and Documentation

Apply using the partnership-based temporary visa application form INZ 1198. Essential documentation includes relationship evidence such as shared address records, joint finances, communication history, and photographs.

You must submit health and character documents, proof of funds, passport copies, and your partner’s student visa and enrollment documents.

Limitations and Special Conditions

The Partner of a Student Visa has specific limitations. If your partner’s study program doesn’t qualify, you will only receive a visitor visa with no work rights. Work visa eligibility depends entirely on the student’s qualification level.

If you and your partner have spent time apart, you must explain and provide evidence for these periods. Immigration officers may delay or refuse applications if relationship evidence is insufficient.

The visa’s conditions are tied to your partner’s student status, meaning changes to their study program may affect your visa validity and rights.
